They govern your access to and use of restsensor.com and the public content, forms, features, and resources offered through it (the “Website”). By accessing or using the Website, you agree to these Terms to the extent enforceable under applicable law. If you do not agree, do not use the Website.

Rest sensor products, purchases, customer accounts, the Rest platform, installations, monitoring, hotel services, support, and other commercial services are governed by separate written agreements and are not licensed, sold, or provided under these Terms.
You must be at least 18 years old and legally capable of entering a binding agreement to use the Website. If you use the Website for an organization, you represent that you are authorized to accept these Terms on its behalf.
We may modify these Terms prospectively by posting a revised version and changing the “Last Modified” date. Material changes apply after reasonable notice where required. We may modify, suspend, or discontinue Website content or functionality at any time without liability, subject to applicable law.
The Website and its content—including text, designs, graphics, logos, photographs, video, software, compilation, and arrangement—are owned by Rest or its licensors and protected by intellectual-property laws. Rest and associated names, logos, product names, designs, and slogans are trademarks of Rest or its licensors. No license to use any trademark is granted.
Subject to these Terms, Rest grants you a limited, revocable, nonexclusive, nontransferable, non-sublicensable right to access and use the Website for lawful internal business evaluation and informational purposes. You may print or download a reasonable number of pages for those purposes if you retain proprietary notices. All other rights are reserved.
You represent that information you submit is accurate, lawful, and provided with all necessary rights and permissions. Do not submit confidential, regulated, or sensitive personal information through public Website forms. Rest may use feedback and suggestions without restriction or compensation, but this does not transfer ownership of your pre-existing intellectual property. TO THE FULLEST EXTENT PERMITTED BY LAW, REST AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID REST, IF ANY, SPECIFICALLY FOR USE OF THE PUBLIC WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Rest, its affiliates, and their personnel from third-party claims, damages, judgments, losses, liabilities, and reasonable costs and attorneys’ fees arising from your unlawful use of the Website, your content or information submitted through the Website, or your material breach of these Terms. Rest may control the defense of a matter subject to indemnification, and you will reasonably cooperate. This section does not require a consumer to indemnify Rest for Rest’s own unlawful conduct.
Before filing a claim, the claimant must send an individualized written notice describing the claimant’s name and contact information, the facts and legal basis of the dispute, and the relief requested. Notices to Rest must be sent to legal@restsensor.com and Rest, Attn: Legal, 11816 Inwood Rd, PMB 71015, Dallas, TX 75226. Rest may send notice to the contact information the claimant provided. The parties will attempt in good faith to resolve the dispute for 30 days after receipt. Any limitations period is tolled during that 30-day period. Either party may seek temporary or preliminary relief when necessary to prevent immediate and irreparable harm.
Texas law governs these Terms, without regard to conflict-of-laws principles. Any dispute arising from or relating to the Website or these Terms must be brought exclusively in the state or federal courts located in Dallas County, Texas, and each party consents to their jurisdiction and venue. This provision does not deprive a consumer of non-waivable protections or venue rights under applicable law.
To the fullest extent permitted by law, any claim arising from or relating to the Website or these Terms must be filed within one year after the claim accrued, or it is permanently barred. This limitation does not apply where applicable law prohibits shortening the limitations period.
These Terms and documents expressly incorporated into them are the entire agreement concerning use of the public Website. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain effective. A waiver must be in writing and does not waive another breach. You may not assign these Terms without Rest’s written consent; Rest may assign them in connection with a merger, reorganization, asset transfer, or by operation of law. Headings are for convenience only. Provisions that by their nature should survive termination will survive.
